Welcome to Infodontics (collectively, the “Service” or “Site”), operated by Infodontics (the "Company"). By accessing or using the Service, you signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), without regard as to whether you are a registered member of Infodontics. We reserve the right, at our sole discretion, to change or delete portions of this Agreement at any time and without further notice. If these Terms of Use change at some time in the future we will post the policy changes here to notify you of these changes.

PLEASE READ THESE TERMS OF USE AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS, INCLUDING BUT NOT LIMITED TO LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE THAT GOVERNS HOW DISPUTES WILL BE RESOLVED.

These Terms of Use apply to members and non-members alike. In order to use the Service, you must accept these Terms of Use. You may do so by (a) registering for membership with the Service and/or Company or (b) by actually using the Service.

You confirm that you are of legal age to form a binding contract with the Company and comply with these Terms of Use. In any case, you confirm that you are over the age of 13, and acknowledge that the Service is not intended for children under 13 years of age. You may not use the Service and may not accept the Terms of Use if you by law are barred from using the Service or accepting the Terms of Use.

Infodontics Intellectual Property

Any trademark or services mark of Infodontics may not be used without the prior written permission of the Company.

You also agree to the following:

  • To use this service consistent with all terms of use, site rules, and in compliance with applicable laws and regulations;
  • To not allow others to use your account and to notify the company if that occurs;
  • Not to upload, transmit, or utilize any material in association with this website that intends to interrupt the functionality of the service;
  • To use any automated program or means to access the site without express written permission of the company.

You agree to not use the service to:

  • Harass, threaten, or abuse any other person or user of the site;
  • Solicit personal information from any user of the site;
  • Engage in criminal conduct;
  • Engage in any illegal use;
  • To distribute any abusive, offensive, pornographic, or obscene material;
  • Advertise or solicit business.

Other Terms and Conditions

These Terms of Use, together with the Privacy Policy, Licensing Policies, Creation Policy and Site Rules, as referenced herein constitute the whole agreement between you and Company regarding the use of the Service, and completely replace any prior agreements between you and Company relating to your use of the Service.

Company Content

Articles, pages, and content that are created by Infondontics are the exclusive property of the Company  (“Original Content”). Except as stated explicitly herein, nothing in this Agreement shall be deemed to create a license to the Original Content, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, edit or create derivative works from the Original Content. Subject to the terms and conditions of this Agreement, Company provides you with a license to use the Company Original Content for your personal, noncommercial use only. Company may terminate this license at any time for any reason or no reason. Use of Company Original Content for any purpose not expressly permitted by this Agreement is strictly prohibited.

Foreign Languages

To the extent that a translation of these Terms of Use differ from the English language version, the English language version controls.

Disclaimers and Limitation on Liability

The Company does not control and is not responsible and is not liable in any manner for any user content submitted to the service.

The Company is not responsible for the content or conduct, whether online or offline, of any user of the Service or any Media Content or other site or services that may be referenced, or linked to, in the Service. Because Company has no control over such sites and services, you acknowledge and agree that Company is not responsible for the availability of such external sites or services, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or services. You further acknowledge and agree that Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or service. You understand that these Terms of Use and our Privacy Policy do not apply to your use of such sites and services. Further, you understand and acknowledge that by using the Services you may be exposed to content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.

The Service is provided "as-is" and "AS AVAILABLE". The Company disclaims any and all representations and warranties, whether express or implied. The Company does not and cannot guarantee any specific results from use of the Service. YOU ACKNOWLEDGE THAT YOU USE THIS SERVICE AT YOUR OWN RISK.

You agree to indemnify the Company, its directors, employees, owners, agents, and users from any liability resulting from your use of this Service or its content or other materials thereon. In no event will the Company, its directors, employees, owners, agents, or users be liable to you or any third party for any indirect, incidental, consequential, special or punitive damages, including lost profit, goodwill, or other loss, be it tangible or intangible, arising from your use of this service or any content or other materials thereon, even if the Company has been advised or was otherwise aware of the possibility of such damage. Notwithstanding anything to the contrary contained herein, the Company's liability to you for any cause whatsoever, and regardless of the form of the action, will be at all times limited to the amount actually paid by you, if any, to use the service, not to exceed one-thousand United States dollars. You further acknowledge that if no fees are paid to the Company to use this Service, you are limited to injunctive relief only, and are not entitled to damages from the Company regardless of your cause of action.

IN ADDITION, THE COMPANY DOES NOT REPRESENT OR WARRANT TO YOU THAT (A) YOUR USE OF THE SERVICE WILL MEET YOUR REQUIREMENTS, BE THEY EXPRESS OR IMPLIED; (B) THAT ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USER OF THE SERVICES WILL BE FREE OF ERROR, ACCURATE OR RELIABLE; (C) THAT ERRORS IN FUNCTIONALITY OR OPERATION OF THE SERVICES WILL BE CORRECTED.

Governing Law, Venue, and Jurisdiction

By using the Service, you agree and acknowledge that the Service is hosted in the United States. If you are attempting to access the Service from a physical location within the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the Service, you are transferring your personal information to the United States and you consent to (a) such transfer, (b) the application of the laws of the State of New York without regard to principles of conflict of laws, which will govern these Terms of Use and any dispute of any sort that might arise between you and the Company or any of our affiliates. You agree not to commence or prosecute any action in connection with your use of these Services other than in the state and federal courts of  New York, and you hereby consent to and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of  New York.

Entirety of Agreement

If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue to be valid and enforceable in full force and effect.

If the Company does not exercise or enforce any right, remedy, or provision of these Terms of Use, this shall not constitute a waiver of such right or provision in that or any other instance.

If any provision of these Terms of Use shall be deemed unlawful by any magistrate of competent jurisdiction, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

Personal Information

The only personal information we collect is what you voluntarily offer during signup. We also store certain information we receive related to your use of the site, such as your IP address. The personal information we do have will never be made available to others, with the following exceptions: (1) legal orders, such as subpoenas (2) repeated serious violation of site rules (3) appropriate requests from compliance, licensing, legal, or other similar departments who need to contact users quickly and directly.

Also, moderators have access to some information to enable duplicate account checking. They also may have information that they have access to as part of the moderation of the site, such as abuse reports, appeals, and other information sent by users to the moderators. Moderators are not allowed to share any of that information with non-moderators or anyone not on this site, unless one of the above exceptions apply.

Cookies

We store a few cookies on your computer, related to logging in and to gathering statistics on unique visitors.

Emails

Users who have signed up for Infodontics may occasionally receive administrative emails.

Analytics

We collect web analytics information about our users in order to help us run the site more effectively. For example, web analytics allows us to see trending information about page views per day, or even things like what percentage of users are using each browser. Our web analytics are provided by third parties, and their privacy policies apply to the information they collect.

Third Party Advertising

Infodontics is supported by advertising. We use various third party ad services to provide the ads that you see on the site. We cannot control what (if any) information is stored by these services. We do not provide any personal information about our users to these services.

Our ad networks use cookies to serve ads on this site. For example, Google's use of the DART cookie enables it to serve ads to your users based on their visit to your sites and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

We allow third-party companies to serve ads and/or collect certain anonymous information when you visit our web site. Commercial Use Waiver

If you contribute to, or have contributed to, a wiki that uses a license that restricts the commercial use of your contribution (e.g., the CC-BY-NC license or the CC-BY-NC-ND license), you hereby waive such restriction with respect to Infodontic’s use of such contribution and any derivative works of such contribution.

Attribution.

As a contributor, you agree that being attributed in any of the following fashions satisfies the attribution requirements of the license applicable to your contribution to a wiki: a) attribution through a hyperlink (where possible) or URL to the article or articles you contributed to, b) attribution through a hyperlink (where possible) or URL to an alternative, stable online copy which is freely accessible, which conforms with the license, and which provides credit to the authors in a manner equivalent to the credit given on this website, or c) attribution through a list of all authors. Any list of authors may be filtered to exclude very small or irrelevant contributions.

Non-text files

Freely licensed or public domain images are strongly preferred on Infodontics.

Non-text media on Infodontics should not be assumed to be available under the same license as the text. Please view the media description page for details about the license of any specific media file.

If you are uploading files to Infodontics, you should cite the source of the file, attribute the authors, and note any copyright information, where applicable. Individual communities may elaborate upon and refine requirements for file uploads.

Translations

These licensing terms are not to be modified. If there is any inconsistency between these terms and any translation into other languages, the English language version takes precedence.


Creation Policy

Community creation policy 

Infodontics  welcomes pages on almost any dental topic, large or small, popular or obscure, modern or historical, creative or documentary. However, your page must contain no hate, no libel, no pornographic content, and no copyright infringement.

You must agree:

Free content 

Text on Infodontics pages is available under a free content license, meaning the information you put on the wiki can be copied and reused by anyone. This is very important to our goal of increasing the amount of free content in the world, but isn't always what creators are looking for when searching for a content host.

Although some fair use material may be included in our communities, Infodontics aims to be a repository of free content, so any wiki which would be primarily made up of fair use material rather than freely licensed material is not permitted. Examples include fan translations of copyrighted works, screenshots of television shows or games, or scans of comic book pages.

Public viewing 

All Infodotics communities are publicly viewable. Infodontics does not provide private communities and there is no option in the software to password-protect or otherwise prevent people from reading any of the pages on a community.

Infodontics communities are indexed by search engines, and contributions may appear prominently in certain search results.

Public editing 

Pages are about working together, and all Infodontics pages are open to the public to edit. There is no option to restrict editing to the founder or to a particular group.

These are community projects, not personal websites. They are not owned by their founders, nor does the founder's opinion carry more weight in disagreements than any other user's opinion. Consensus and cooperation should be the primary means for organizing a community.

No abuse 

Pages or entries which consist only of offensive material or personal attacks will be closed.

A user who is banned on other communities or who abuses the wiki creation tool may be blocked from creating new pages.

Users may not create pages with offensive or abusive titles or urls. We know it is not possible to block every possible abuse. Users who create pages/entries in bad faith will simply have their wiki deleted and their user account banned.

Please contact staff (mandilyn@infodontics.com) to report any abusive community names that we have missed, or if the filter mistakenly prevents you from using an innocent name.
